The Clean Water Act (CWA) dramatically improved the quality of U.S. waterbodies. However, 40 % of the nation's waters still do not meet standards and the leading source of pollution is runoff.
The National Pollutant Discharge Elimination System (NPDES) permitting program addresses stormwater discharges. Phase I covers stormwater from medium and large municipal separate storm sewer systems (MS4s) with populations of 100,000 or greater, and construction activity disturbing 5 acres of land or greater. Phase II program expands the Phase I program by requiring additional operators of MS4s in urbanized areas and operators of small construction sites. It also authorizes EPA to require permits for other stormwater sources as necessary to implement total maximum daily load (TMDL) allocations.
